Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ConservaCam ecosystem, which includes our website, Mobile Application, Web Dashboard, physical hardware devices, and the JRPCC Client Portal (collectively, the "Services") operated by ConservaCam ("us", "we", or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Services.
1. Account Security and Roles
When you create an account, whether as an Admin, Ranger, Researcher, or standard User, you must provide accurate and complete information. You are solely responsible for safeguarding the password and access tokens for your account. Unauthorized sharing of credentials, especially those granting access to sensitive field deployments or JRPCC documents, is strictly prohibited.
2. Hardware, Drones, and Field Operations
The ConservaCam ecosystem heavily integrates with physical hardware (Camera Traps) and drone survey platforms. By using these Services, you agree to the following:
- Legal Compliance: You are solely responsible for ensuring that the physical deployment of camera traps and the operation of drones comply with all local, regional, and national laws, including wildlife protection regulations, aviation laws, and trespass laws.
- Hardware Disclaimers: We provide no warranty against environmental damage, wildlife interference, or theft of hardware deployed in the field, except as explicitly defined in a separate written hardware purchase agreement.
- Safety & Geofencing: Geofence alerts and anti-theft notifications provided by the App and Dashboard are informational tools. We do not guarantee immediate prevention of theft or damage.
3. Artificial Intelligence & Media Processing
A core feature of ConservaCam is the automated analysis of media. By uploading images, video, or drone telemetry—either manually or automatically via hardware—you grant ConservaCam a worldwide, royalty-free license to host, store, and process this media.
- AI Analysis: You acknowledge that uploaded media will be processed by our machine learning models to detect, classify, and count wildlife species.
- Data Accuracy: While our AI is highly trained, we do not guarantee 100% accuracy in species classification or headcounts. Data should be verified by human operators for critical research.
- Human Detections: As outlined in our Privacy Policy, media identified as containing human presence is handled under strict security protocols and is not used for generalized model training.
4. JRPCC Client Portal and Research Permits
For researchers utilizing the JRPCC Client Portal to submit permit requests (including PIC, MAT, and MTA documents), the following applies:
- Document Authenticity: You warrant that all legal and consent documents submitted via the portal are authentic, unaltered, and legally binding within your jurisdiction.
- Intellectual Property: You retain all intellectual property rights to your specific research data. However, you grant ConservaCam the necessary permissions to process, store, and route your application to the appropriate review committees.
5. Limitation of Liability
In no event shall ConservaCam, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, loss of data, loss of field equipment, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) any unauthorized access, use, or alteration of your transmissions or content.
6. Modifications to the Service and Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes via the Dashboard or email prior to the new terms taking effect. Your continued use of the Services after revisions become effective constitutes your acceptance of the revised terms.
